This is a translation. The Danish version prevails in case of any discrepancy.
1. About Postly
Postly is run by GN, CVR 38823574, Nordre Fasanvej 207A, 1. 02, 2000 Frederiksberg, Denmark. Contact us through the contact form at postly.dk/en/contact.
2. The agreement
The agreement is made when you have completed the payment. You receive a confirmation by email with your order number.
3. Prices and payment
All prices are in Danish kroner (DKK) and include 25% VAT. A standard letter costs DKK 69 and a registered letter DKK 289. Both include up to 5 A4 pages. Extra pages cost DKK 5 per page. Payment is made securely by card with our payment provider; Postly never receives or stores your card details. Business customers with a prepaid balance can have unused balance paid out on request, see the business terms (in Danish).
4. Delivery
Letters received and paid before noon on weekdays are posted the same day. dao then delivers standard letters within 5 weekdays. For registered letters, dao makes the first delivery attempt within 5 weekdays. We only send to addresses in Denmark. A letter may only contain paper, not goods or objects, and it must be bendable.
4a. Deletion of the letter's content
The letter itself, meaning the uploaded file or the typed text, is deleted automatically and irreversibly by the automatic clean-up 7 days after sending or 30 days after payment, whichever comes first. Delivery receipts from dao for registered letters are stored separately from the letter and deleted 90 days after we have forwarded them, and no later than 120 days after sending. After that we keep only order details without the letter's content, because they must be kept under the Danish Bookkeeping Act. This means we cannot reprint, resend or hand over a letter after the 7 days. Complaints about production must therefore be made before then.
4b. Postly as the sender
If you choose the add-on Postly as the sender, Postly's address is shown as the sender on the envelope instead of yours. If the letter comes back, we tell you by email. We keep the letter for 30 days and then shred it, unless you ask us before then to send it to another address. That is a new order.
5. Right of withdrawal
As a rule you have a 14-day right of withdrawal when you buy online. When you order, you expressly request that Postly starts the personalised service immediately after payment. When the service has been fully performed, the right of withdrawal ends. If you withdraw before the service has been fully performed, you can contact us through the contact form. You must then pay a reasonable amount for the part of the service already performed. A letter that has already been printed or handed over for delivery cannot be recalled.
6. Complaints about delivery
Once the letter has been posted, dao is responsible for delivery. If your letter is not delivered, or if you have questions after posting, contact dao's customer service. For registered letters, give the hand-in code or the R-mark number you received by email when the letter was posted. dao sends the delivery receipt to Postly when the letter has been delivered, and we forward it to you. It usually takes 2 to 5 weekdays, but longer if the recipient is not at home and has to collect the letter. If the recipient does not collect the letter, there is no delivery receipt, and we let you know when we hear from dao. If there is an error in our handling before posting, contact us on the contact page no later than 30 days after posting.
7. Liability
Postly prints, envelopes and hands the letter to dao. The customer is the sender and owner of the letter and is responsible for its content, the recipient and the time of sending. Postly does not review the content, does not give advice and does not carry out debt collection for others. The service must not be used for illegal, harassing or misleading content. Postly may refuse orders that breach these terms.
Templates and guides
Templates and guides are provided as they are, without any guarantee of accuracy, completeness or legal effect. You use them at your own risk. Postly is not liable for any loss resulting from their use.
Limitation of liability
Postly's total liability is limited to the amount the customer paid for the order in question. Postly is not liable for indirect loss, loss of profit, delays or errors at dao, or for whether a letter has a particular legal effect or arrives before a deadline. A registered letter documents sending and delivery under dao's terms. These limitations apply only to the extent mandatory law allows, and do not limit the customer's mandatory rights.
Emails and personal data
We send receipts and updates about your letters. We only send emails about Postly's services as described in the privacy policy, and you can always unsubscribe.
Business customers and personal data
When a business customer sends letters or uploads recipient lists, Postly processes personal data on the customer's behalf and on the customer's instructions, only to print and send the letters. The customer is responsible for having a legal basis for the processing and for sending the letters. If the customer chooses a QR code on the letters, it leads to the customer's own web address, and Postly does not record who scans it. The customer is responsible for the content behind the code and for complying with the rules on addressed advertising, including the Danish Robinson list. For business customers, the business terms and the data processing agreement (in Danish) also apply.
Letter content and related documentation files, including receipt photos and copies of the letter, are deleted by the automatic clean-up 7 days after sending or 30 days after payment, whichever comes first. Delivery receipts from dao for registered letters are stored separately from the letter and deleted 90 days after we have forwarded them, and no later than 120 days after sending. Unpaid single orders are deleted after 48 hours. Business drafts are deleted after 30 days without updates. Shared letter content and the recipient list for a mailing are deleted when the content of all the mailing's letters has been deleted. Order details without letter content are kept for bookkeeping. See the privacy policy.
We use suppliers for payment, hosting, operations and email, and dao as the postal operator. Personal data is stored within the EU/EEA. The letters are handled by Postly's fulfilment team for printing, enveloping and hand-over to dao.
8. Partner programme
Postly has a partner programme where approved partners can refer customers through a personal link and receive a commission on paid letters. If you come to Postly through such a link, an internal partner number is stored in your browser for up to 30 days. The price for you is the same, and the partner does not get access to your information. The terms for partners are on the Partner programme page.
9. Complaints
Complaints can be brought before the Danish Centre for Complaint Resolution (Center for Klageløsning), Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark. See naevneneshus.dk.
